How do I file a motion with the court to drug test my child’s mother? I know she’s on drugs, she lives with her mother and her own mother told me she’s on drugs. I would like to get her drug tested then have residential custody switched to me. We already have shared parenting but with all the drug dealers she’s hanging out with I’m afraid my son will be affected.
Speaking from the outside looking in: You need to have stability in your home setting in order to petition the courts for full custody.That should be a priority. Then you use the fact that she is in such an unstable and endangering environment, that it is a possible threat to the proper upbringing of your son. Remember, all the courts are interested in is facts, so make sure to get a statement from her mother concerning her lifestyle

in filing a motion, you based it on your concerns about her drug use and you request drug testing, I would seek out legal advice, she can deny any drug use which I would think she would when you file a motion against her

my daughter went willingly because she wanted to prove to her ex she wasnt. even i beleived she was on drugs until the hair folical came back negative and she had no advanced notice it was coming.So try talking to her if not get a lawyer and go that way

You have to have tangible proof of her using and hearsay (Her mother saying so) is not tangible proof. Hanging out with drug dealers doesn’t mean she is using.
